URL: From drkael at comcast.net Tue Feb 7 08:39:33 2012 From: drkael at comcast.net (Michael Macchione) Date: Tue, 7 Feb 2012 08:39:33 -0500 Subject: [Populace] Lawsuit Settlement- Status Message-ID: <003601cce59d$ed5db7b0$08455244@macchione> Unto the Shire of Caer Adamant, does Lord Mikael "Kael" McCue, current Exchequer and sole candidate for Seneschal bring the following information for your consideration: As many of you may have heard by now, SCA Inc had been involved in a major lawsuit that has recently come to a settlement. (Information regarding this can be found at http://www.sca.org/BOD/announcements/settlement.html ). In a quick summary, SCA Inc has agreed to pay $1,300,000 to the plaintiffs. SCA Inc has two insurance policies to cover this situation. The first has agreed to pay $450,000. The second has denied coverage. We are currently suing that insurance company and hope to have a decision by May. However, payment of the settlement must be paid prior to then, thus SCA Inc needs to cover $850,000. Having already spent a half million dollars on this lawsuit already, SCA Inc corporate offices does not have this money. As is their legal right, they have asked all North American kingdoms (other kingdoms do not fall under SCA Inc) to send 18% of their total kingdom cash assets (kingdom bank accounts and local groups) to corporate to cover this settlement. If the lawsuit against the insurance company results in them paying the SCA, then any money received will be used to re-imburse the kingdoms in proportion to their payments made. Last night, their Majesties Gregor and Kiena invited the landed barons and baronesses, seneschals and exchequers of the East to a conference call to discuss the situation. Here is a summary of the phone call: The total cash of all accounts in the East Kingdom is roughly a half million dollars, thus the EK's share is to be $95,000. Due to requirements from the court, to meet the timeline, the kingdoms must have payment to corporate by February 16th. Currently, the EK has $168,000 at its disposal (150,000 in money markets, 18,000 in the checking account). The decision reached by their majesties and the kingdom seneschal and exchequer is that the East Kingdom will completely cover our share and that local groups will not be required to give any money. I repeat, local groups will not be required to send 18% of their funds to kingdom. Although, not required, donations will be accepted. (more on this below). Unfortunately, other kingdoms are not in the same position that the East is in. Their kingdom accounts will not cover their payment, or will cause their account to be practically empty, and will thus have to ask their local groups for money. Due to the short timescale to get the payments to the corporate offices, and the time it can take to get money from all of their local groups, some kingdoms might not be able to get the money together in time. The East Kingdom is looking to loan some of these kingdoms money to help meet the deadline. Again, their majesties asked for donations to help with this cause. Any donations received will allow the East to give additional help to other kingdoms. Their majesties have stated that any money that the Kingdom receives back due to this situation (either returns from loans to other kingdoms, or as a result of the lawsuit against the insurance company) will be used to payback local groups first. Thus, if Caer Adamant decides to give some money to Kingdom, there is a chance (and I believe a good one) that we will receive at least a portion of that money back. Note: individuals and households may donate money to Kingdom as well, however, due to our non-profit status, money coming from non-SCA Inc. accounts cannot be repaid, and must be a true donation. These donations would be tax-deductible though. Currently, The shire bank account has approximately $4700. This is lower than normal due to the fact that we have paid $1560 to the UUFN, half being the site fee for Everyday Thynge, our event next month, and the other half being a returnable security deposit. I am confident that after the event, when the event fees are deposited, security depost is returned, and event expenses paid out, that our account will be back to at least $6000, which is our normal level. As exchequer, I feel that we can afford to send $1000 to kingdom without any hardship on the part of our shire. Especially with the knowledge that this may just be a short term loan. (note $1000 is approximately 18% of $5500 which is how I came up with the amount). As the sole candidate for seneschal in next week's election, I feel that making a donation of any size would be good for our shire, showing that not only are we willing to support our kingdom, but by extension, that we are willing to help out other kingdoms as well as the Society as a whole. The kingdom is willing to give up nearly 60% of its finances so that the local groups do not have to. I feel it is only appropriate to show our appreciation of this, in helping them support other kingdoms by making a donation/loan. Unfortunately, due to the timescale of this, we do not have the ability to go through normal channels to do this. Kingdom would appreciate notice of any donations as soon as possible, so that they might know how much they can afford to spend. As the deadline for the kingdom to send money to the Society is next Thursday, discussing this at the business meeting next week would be last minute. Thus, I am asking people to voice their opinions on this topic (whether we shall make a donation, and if so how large a donation), either by commenting on the Yahoo list, or sending their opinions directly to me or to any of the officers within the next 72 hours, so that the officers can make a decision on this and can let the kingdom know of our decision by the weekend. I know I could have gone directly to the officers on this, but I feel that a decision like this should be made by the entire shire since it does effect all of us. And I apologize for possibly stepping on people's toes by sending this out without consulting anyone, but again time is working against us on this. This is an awful situation and everyone wishes that it did not have to happen. However, the spirit that everyone seems to be in is that we should not dwell on the negatives, but to work together to get this behind us and move forward. I await your commentary. If you have any questions, please feel free to ask and I will try and get the answers for you. -------------- next part -------------- An HTML attachment was scrubbed... For those who have not heard, as of the last meeting, I am now the seneschal of Caer Adamant.? I would like to thank Baroness Hedewigis for her many years of dedicated service to the shire, as well to Baron Padraig for acting as interim-seneschal between when Hedewigis had to step down and the election. ? There were several other changes at the elections to officer positions: ? Lady Veronica -- Exchequer Lady Shoshana -- Chatelaine? Lord Wulf -- Herald Baron Adolphus -- Chronicler ? Mistress Margaret and Baron Padraig were renewed as Minister of Arts and Sciences and Captain of Archers, respectively. ? Lord Mark is still Knight's Marshal; the only office that was not up for?election this time. ? I wish to thank Lord Alexi and Lady Magdalena for their time and service in their offices. ? So, I ask you to welcome all of the new officers to their positions, and please?have some patience as we all?go through the transition to our new roles. ? ? ?Another change that is going on, is our website is being updated.? Lord Enoch has graciously been working on updating the information on the website; giving it a new look, and getting current information on the front page!!!???It is still a work in progress, however,?I?think you will like some of the new features that he has already ?put on it. ? I have been thinking of how I want to run things, and there will probably be some changes in how things happen.? I'm not Hedewigis... different people different styles. I will also be open to new ideas.? Any suggestions are welcome. Kael Seneschal, Caer Adamant -------------- next part -------------- An HTML attachment was scrubbed... URL:
